Step Automatic Payday Transfer Terms
Provided by: Step Mobile, Inc. (“Step”), a Delaware corporation headquartered in California. Banking services provided by: Evolve Bank & Trust, Member FDIC (“Evolve”).
1. Overview
The Automatic Payday Transfer feature (the “Service”) enables you to link the external account where your paycheck is deposited (“External Account”) and automatically transfer a selected portion of each paycheck into your Step Account after Step detects your employer’s deposit. This Service does not change where your employer deposits your paycheck or modify your direct deposit instructions.
2. Eligibility and Account Connection
To use the Service, you must be at least 18 years old, maintain a valid Step Account, and link your External Account through a secure third-party data provider such as Plaid. By linking your account, you authorize Step, Evolve, and the data provider to access, transmit, and use information from your External Account in accordance with Step’s Privacy Policy and the provider’s terms. You represent that you are the legal owner of the External Account and have authority to authorize electronic debits from it.
3. Detection of Paycheck Deposits
Step uses transaction data from your External Account to identify payroll deposits. Detection may not occur in real time and may depend on the information provided by your financial institution. Step does not guarantee that all payroll deposits will be identified or that detection will occur immediately upon receipt of funds.
4. Authorization for Recurring ACH Debits
By enabling this feature, you authorize Step and Evolve to initiate recurring electronic fund transfers (ACH debits) from your External Account in the amount or percentage you select and to deposit those funds into your Step Account.
This authorization will remain in effect until you cancel it in the Step App or until your Step Account is closed. You may revoke this authorization at any time by disabling the Service or contacting Step Support, but cancellation will not affect transfers already in process.
This authorization is provided in accordance with NACHA Operating Rules and the Electronic Fund Transfers Act (Regulation E).
5. Transfer Timing and Processing
Transfers are processed through the ACH network. Although Step will attempt to initiate transfers on the same business day a paycheck deposit is detected, completion typically takes one to three (1–3) business days. Processing may be delayed by weekends, bank holidays, cutoff times, or technical issues. Transfer initiation does not guarantee same-day settlement.
6. Insufficient Funds and Failed Transfers
You are responsible for maintaining sufficient funds in your External Account. If the transfer amount exceeds your available balance, your financial institution may reject the transaction or charge overdraft or return fees. Step and Evolve are not liable for any such fees or resulting losses. If a transfer fails, Step may retry it in accordance with NACHA rules or skip it at its discretion.
7. Variable Paychecks and Adjustments
Paycheck amounts may vary due to taxes, deductions, or other changes. Step may adjust or skip a transfer if funds are insufficient or if the detected deposit does not meet the expected amount. Step does not guarantee that your selected dollar amount or percentage will always be available for transfer.
8. Data Security and Privacy
Step and Evolve use commercially reasonable safeguards to protect your personal and financial information. However, no electronic system is completely secure. You acknowledge that data transmission through third-party networks carries inherent risks and that Step cannot guarantee absolute security. For details, refer to Step’s Privacy Policy.
9. Service Availability
The Service may be interrupted or suspended for maintenance, security, or operational reasons. Step makes no warranties that the Service will be available, error-free, or uninterrupted.
10. No Financial, Investment, or Tax Advice
This Service is provided for convenience and money-management purposes only. It does not constitute financial, investment, tax, or legal advice. You should consult a qualified professional before making financial decisions.
11. Limitation of Liability
To the fullest extent permitted by law, neither Step nor Evolve shall be liable for any indirect, incidental, consequential, or punitive damages arising from use of the Service, including delays, detection errors, failed transfers, or overdraft fees.
Step’s total liability under these Terms shall not exceed the total amount of fees, if any, paid by you for the Service.
12. Changes and Termination
Step may modify, suspend, or terminate the Service or these Terms at any time. Material changes will be communicated through the App or via email. Continued use of the Service after notice constitutes acceptance of the revised Terms.
13. Governing Law
These Terms and the Service are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law principles. You agree that any disputes will be resolved in the federal or state courts located in San Francisco County, California, unless otherwise required by law.
